Data protection policy - General part for all companies within Zmarta
We know how important privacy is to our customers and website visitors. The goal of our data protection policy is to clearly and transparently describe to you how we collect, use, display, transfer and store data and information about you - all so that you can feel secure that your personal data is in safe custody and treated correctly. We carry out all processing of personal data in accordance with applicable data protection legislation.
Processing of personal data
The companies within Zmarta, "Zmarta", process your personal data so that we can provide, and you can use, our services. How the personal data is processed depends on which of our services you have chosen to use.

By using the mediation services, e.g. by visiting our website or by applying for a loan or insurance, you confirm that you have read and understood the content of Zmarta's data protection policy. If you compare electricity or insurance through Elskling and Zmarta Försäkring respectively, you also confirm that you have read the relevant company's data protection policy by using the service.
Zmarta stores information about how you use our services, for example which application channel you used, when the application was made, at what times we have been in contact with you and what the contact was about.
If you apply for a loan, insurance or compare and change electricity contracts via Zmarta's services, we will disclose your personal data to the lenders, insurance companies and electricity companies that are connected to our service and that are relevant to your application. The respective lender, insurance company and electricity company are responsible for personal data for the processing of personal data that it carries out in connection with your application. You are asked to carefully read the lenders', insurance companies' and/or electricity companies' information about their processing of personal data. Here you will find information about how our partners will process your personal data.
In cases where we link to a third party website, such reference is intended solely as a service to the user and we disclaim all responsibility for such third party website and any personal data processing by such third party.
Personal data controllers
Personal data controllers for Zmarta's services in Sweden are:

In this data protection policy, we explain how your personal data is processed both for each service and within the framework of Zmarta's common customer database. Zmarta AB (556647-0737) administers and manages a group-wide database for the Zmarta companies, and performs the processing on behalf of the Zmarta company that is responsible for personal data where you are a customer or whose services you use. All companies participating in the collaboration are majority-owned companies in the Zmarta group ("we", "Zmarta").
The companies within Zmarta largely share administrative systems and have common functions that carry out customer support, marketing work and data analysis. Personal data is collected by transferring the personal data processed by the respective Zmarta companies to the database after which it is processed in accordance with what is stated in this information. Zmarta AB is responsible for managing the technical system, and associated security measures, on which the database is based.
Personal data processing
We collect information from you as a customer in order, among other things, to be able to offer our services and fulfill our commitments in relation to you. We collect different information depending on the service you use.
For the processing of personal data, there must be support in legislation, a so-called legal basis.
Legal Basis
In order for our processing of your personal data to be legal, it is required that it is necessary (i) to fulfill our agreement with you, or (ii) to fulfill a legal obligation for Zmarta. Processing of personal data can also take place with the support of (iii) a balancing of interests/legitimate interest or (iv) after you have given your consent to carry out a certain processing.
In cases where the processing is necessary for purposes related to the legitimate interests of Zmarta or third parties, Zmarta can process your personal data based on a balancing of interests. Such interests include Zmarta's commercial interest in maintaining a good customer relationship with you, to provide you with information relevant to your use of our services, to improve and further develop our services, and to market Zmarta, its various services and/or companies and brands within Zmarta.
What personal data is collected?
Below is more detailed information about which categories of personal data we collect and which processing we carry out, for which purpose and based on which legal basis:
Personal details and contact information
You provide certain information to us in connection with using one of our services, such as personal and contact information, such as name, address, telephone number and e-mail address. We collect certain information about you in connection with and/or after you submit your application to us, e.g. updating your personal data or supplementing data via external registers such as for example UC, Bisnode and SPAR or other similar partners.
In some cases we exchange, e.g. your customer number between us and our companies and partners to facilitate the handling of your insurances or other customer matters.

Purpose: we need the information to be able to provide our services to you. We also need the information to communicate with you and present offers, for direct marketing, for developing and ensuring the functionality of our services, for information security, for customer service and to prevent abuse of our services and to fulfill legal obligations. The information is also used by us to compile statistics, for segmentation and for analytics purposes. It can also be used to evaluate and improve the effectiveness of our marketing vis-à-vis others on, for example, social media.

Sharing of information: Your email address and phone number may be shared with suppliers for the purpose of marketing our services on, for example, social media. The processing may take place for the purpose of marketing our services to you and to improve our marketing in relation to other potential customers. The treatment is based on a balancing of interests. We ensure that our interest outweighs your right not to have your data processed for this purpose. If you choose to take part in a campaign or an offer, for example free insurance, name and address information is shared with the partners who provide these services.
Company information
In the event that you are acting on behalf of a company, we also collect company information such as organization number, company name, address and zip code. We also store information about your position/function in the company as well as information about the company's owner/beneficial owner and share of ownership. The information is provided by you and/or collected by third parties.

Purpose: we need the information to be able to provide our services to you and the company you represent. We also need the information to communicate with you and present offers, for direct marketing, for developing and ensuring the functionality of our services, for information security, for customer service and to prevent abuse of our services and to fulfill legal obligations.
Legal basis: fulfillment of our agreement with you and the companies you represent as well as fulfilling a legal obligation and/or legitimate interest.
IP address, certain cookies and technical data
We also store information about how you use our services, e.g. which application channel you used, when the application was made, at which times we have been in contact with you and what the contact was about.
When the application is made via digital channels, we use cookies and other digital tools for search optimization, tracking and follow-up as well as IP address and/or information about the device you used when using our online services. Read more about this in our cookie policy.

Purpose: We use the IP address for identification and to recognize your settings in order to offer a better user experience. We also collect the IP address for administrative reasons, e.g. to be able to see which channel you used to get to our website. In addition, we save the IP address in order to prevent fraud. We collect technical data about your device to reduce the risk of misuse of our services and your data, as well as to make technical improvements and troubleshoot. Legal basis: We use balancing of interests for all purposes regarding IP addresses and technical data as well as your consent in relation to cookies in the manner specified in our cookie policy.
Sharing of information: for administrative reasons, the IP address may be shared with our marketing partners, for example to see how and where you made your application, in connection with legal action, suspicion of crime (e.g. fraud or money laundering) or potential threats to Zmarta or the rights of others, and the IP address can be disclosed to affiliated lenders and insurance providers as well as to the police and other authorities. In the service, you may sometimes be offered to share information from the service on social media, such as Facebook or Twitter, via an implemented social plug-in (such as a like button). We do not have full influence over the information social media collects using these plug-ins if you choose to use them. We therefore urge you to keep yourself informed about the purpose of, and the scope of, the data collection that is made via media plug-ins.
Credit information as well as information about payment notices and any debt balance with the Swedish Enforcement Agency (Kronofogden)
We may also collect information about your credit rating and/or income as well as the amount of the loan granted. When you apply for a loan, we order a credit report on you. We also collect application information, e.g. information about your income and bank account.
Purpose: In connection with your application for a loan mediation with us, we obtain credit information about you from UC AB or another credit information provider. Information about payment notices and any debt balance with the Swedish Enforcement Agency (Sw. Kronofogden), which is included in the credit information, is processed so that we can send your application to the relevant lender. If you do not provide this information, we are unfortunately unable to provide mediation services to you.

Application information
Application information may consist of various data needed to be able to provide the specific service you requested.
When applying for products such as sickness and accident insurance, information is collected from you regarding any health declaration. This information can also be used in claims settlement for certain insurance products administered by Zmarta.
Social security number and any health information regarding your children may be collected from you in connection with your application for products such as child or accident insurance.
Furthermore, object information can be retrieved, such as the name of the object you want to compare and/or take out insurance for, e.g. registration number, your apartment's address or the property designation of your house. We may also collect information about other objects you own.
(e.g. information on income, employer, bank account number, requested loan amount/insurance, purpose of loan, PEP (Politically Exposed Person)).
Purpose: Data is necessary for us to prepare and send an application to connected lenders and insurance providers and to prevent money laundering and fraud. The information is also used by us to compile statistics, for segmentation and for analysis purposes. Information about whether you, or a close relative, is a politically exposed person is a legal requirement according to anti-money laundering legislation in order to apply for a loan.

Third Party Data
We may also collect data from third parties, for example Bisnode, in accordance with what is stated below. We protect information obtained from third parties according to the methods described in this policy and according to any additional restrictions that apply to the source and scope of use of the information. Such third party sources may vary over time but may include:
- Data brokers from whom we purchase demographic and statistical data, to ensure quality and supplement information we collect, such as e.g. name and postal address. This information can also be used to develop our services to be able to provide more relevant offers,
- Partners with whom we collaborate to offer services or engage in joint marketing activities,
- Publicly available sources, such as open government databases or other data available to the public.
Purpose: Data is necessary for us to prepare and send an application to affiliated loan and insurance providers. The information is also used by us to compile statistics, for segmentation and for analysis purposes. The data is also used for marketing purposes.

Transfer of personal data to third parties
We will not share, sell, transfer or otherwise disclose personal information beyond what is stated in this privacy policy, unless we are required to do so by law or as a result of a court order or if we have obtained your consent to such disclosure.
Zmarta may disclose personal data to third parties, such as the police or another authority, if it concerns the investigation of suspected crime or if we are otherwise obliged to disclose such information based on law or authority decision.
Zmarta can engage external suppliers to perform tasks on Zmarta's behalf, e.g. to provide IT services, update address information or help with marketing and analytics. The performance of these services may mean that Zmarta's suppliers, both within the EU/EEA and outside the EU/EEA, gain access to your personal data. These suppliers process personal data on our behalf in accordance with written personal data processing agreements and our instructions. Personal data processors who gain access to your personal data (e.g. when we use a third party, such as SPAR or BriteVerify, to collect address details, store information on a server or verify email addresses), are not given any right to use your personal data for purposes other than those stated in this personal data policy,
For what purposes do we use your personal data?
Provision of our services
We use your personal data to provide our services to you and to confirm your identity (among other things in accordance with the Act on Measures Against Money Laundering and Terrorist Financing), prepare your application and send it, and your personal data, to our affiliated loan, insurance and electricity companies and inform you about your application. Zmarta needs this information to enter into and fulfill our agreement with you. If you do not provide this information, we are unfortunately unable to provide mediation services and/or the Benefit Agreement to you.

Communicate with you
Via post, telephone, digital communication (SMS, e-mail, social media accounts or via our chat function) or in other ways, e.g. when we send information and are in contact with you regarding questions regarding our services.

Direct marketing
Your personal data may be used to offer you the same, similar and other services from companies within the Zmarta group through direct marketing. We process various types of data in order to be able to market our products and services directly to you. The marketing can take place via e.g. phone, SMS and e-mail. For this purpose, we may also compile statistics for analysis. Your personal data is also used for analysis and segmentation in order to direct relevant marketing to you.
To be able to send relevant direct marketing, we analyze which customer group you belong to and carry out segmentation based on, among other things, the registered person's age and address and how they used Zmarta's services. We also use machine learning models to be able to send you relevant marketing and optimize our marketing

Marketing via external advertising platforms
Zmarta uses third-party advertising platforms for digital marketing. When Zmarta's services are marketed through such channels, Zmarta uses the services of third parties to create "lookalike" audiences and custom audiences, which includes profiling.
Profiling takes place, among other things, when creating target groups on Meta's and Google's platforms as well as when creating customized target groups on Google's advertising network. The purpose of the profiling is to provide you with information and marketing that we believe is suitable for the customer group to which the data subject belongs. The profiling is based on the personal data we have collected about you (e.g. address and age and which services the data subject has used). Based on this information, you are placed in a customer group and receive marketing that is tailored to that customer group.

Development of and ensuring the functionality and efficiency of our services
We use the data to e.g. analyze and understand market trends, in order to develop and improve our products, services and processes. In this regard, we can e.g. analyze user behavior in our digital services to improve functions and their presentation to offer you a better user experience. For this purpose, we may also compile statistics for analysis needs and machine learning, e.g. how you use and navigate our services.

Information security and prevent misuse of our services
We process data in order to ensure the security of our services and to control, prevent, investigate or take other measures in connection with the misuse of our services or in connection with the use of our services in violation of the terms of use, or in connection with legal measures, suspected fraud or money laundering crimes or potential threats to Zmarta or the rights of others.

To fulfill legal obligations
We process your personal data to fulfill our legal obligations. We need e.g. to process and save personal data in accordance with the Accounting Act, the insurance distribution, loan mediation and anti-money laundering legislation.

Document communication with our customer service and our salespeople
When you call or are called by our customer service or our salespeople, the call is recorded. This processing takes place to ensure that we have documented what was agreed or documented. Recording is done to document the application process, document customer awareness under the Anti-Money Laundering and Terrorist Financing Act, and for educational and quality purposes.

Segmentation
We process your personal data to support Zmarta with privacy-safe analysis including simpler segmentation of customer groups, based on e.g. age and address, to provide you with relevant marketing, as well as to improve functions and the presentation of products, services and processes to offer you a better user experience. For some simpler analysis and segmentation, social security numbers are used, in order to be able to send targeted advertising with relevant offers to different target groups.

Analysis of customer behavior and business operations
To give you a better customer and user experience, we use data to, with the support of the group-wide analysis function, make analyzes that enable us to run and protect our business, provide better experiences for customers and make well-founded decisions. As part of this treatment, we develop and use machine learning models.
We use anonymous data that does not consist of personal data when analyzing customer insight, product development, personalization, trends, statistics and similar purposes. By maintaining a joint and quality-assured analysis capability in Zmarta, we ensure correct and secure handling of our customers' personal data for permitted purposes, which are described in more detail in this policy.

Where is my personal data processed and to whom is it disclosed?
Your personal data will be shared between the various companies within Zmarta, regardless of which service you have used in accordance with what appears in this policy.
Common information within the Zmarta companies
We jointly use information that the Zmarta companies collect about customers and users for these main reasons:
- provide an integrity-protected customer register to the Zmarta companies, where we have jointly quality-assured that information and preferences for you as a customer are correct, up-to-date and purpose-limited, and where we can also offer you a simple way to exercise your rights and request your personal data to the joint function administered by Zmarta AB,
- support the Zmarta companies with privacy-safe analysis so that the companies can improve existing products for you as a customer and provide digital services that are customized for you,
- support the Zmarta Companies with privacy-safe analytics so that they can run relevant campaigns marketing to you Zmarta's similar goods and services, and support Zmarta with privacy-safe analytics to, where authorized by you, or where permitted by law, target relevant digital advertising for you.
To improve the protection of your personal privacy, we have built in technical and organizational safeguards designed to prevent certain combinations of data, limit the use of your data according to your preferences and instructions, and ensure that we have accurate and up-to-date information about you and your preferences.
To deliver our services, we may need to disclose your personal data to subcontractors and partners. These parties may not use data about you for any purpose other than to provide the Service or on the terms we specify. You can always be sure that we will not sell your personal data to an external third party for marketing purposes.
To deliver our services, Zmarta uses external providers, including for data storage and backup and provision of document and email systems (e.g. Amazon Webservices and Microsoft). In various areas, we engage suppliers, subcontractors and in some cases also our own companies within the group, to be able to deliver our services. This means that they also need certain information about you as a customer. In some cases, your personal data may be shared with other companies and partners, such as providers of public registers and statistics.
Your personal data may be disclosed by a company within Zmarta to another Zmarta company to present relevant information and optimize our marketing regarding this company's products and services.
To promote our services in digital advertising networks, we use third parties that provide advertising services. Who these parties are is shown in our cookie policy. Several of these third parties use personal data for their own purposes and in accordance with their own policies.
We also use affiliate networks with whom we may share limited information necessary to track traffic and remunerate the affiliate networks that Zmarta partners with to drive traffic to Zmarta's services. Affiliate networks may act as data processors and as independent data controllers.
In the event that Zmarta, or a significant part of Zmarta's assets, is sold to a third party, your personal data may also be shared with such third party due to such sale.
Zmarta may disclose personal data to third parties, such as the police, the tax office or another authority, if we are obliged to disclose such information based on law or authority decision or if we otherwise have a legitimate interest in being able to show and demonstrate how our licensed activities are conducted in connection with an audit.
Transfer to third countries
Zmarta always strives for your personal data to be processed within the EU/EEA and all our own IT systems are located within the EU/EEA. Zmarta mainly cooperates with partners who process personal data within the EU/EEA. If we hire suppliers outside the EU/EEA (so-called "third country"), e.g. cloud services such as Amazon Web Services, Inc. or Google Inc., we will take appropriate safeguards and ensure that transmitted data is handled in accordance with applicable law. Appropriate safeguards may be the signing of agreements that include the standardized rules for data transfer that have been adopted and approved by the European Commission.

This is how we protect your personal data
Zmarta puts security in focus and protects your data in accordance with the data protection regulation and established guidelines for information security. This means that we protect your data with both technical solutions, e.g. encryption of information, and organizational routines and rules, e.g. authorization management, adapted to the type of personal data processing. We follow our information security policy and work continuously with record keeping and review of our collaboration agreements regarding the processing of personal data and agreements with personal data processors.
Automated Decision Making - What is it?
"Automated decision-making" is a decision made solely based on an automated processing of your data. This is done using, for example, a program code or an algorithm. Zmarta continuously ensures that the automated decision-making processes work correctly. Zmarta's use of automated decision-making is aimed at providing fair and accurate loan and insurance mediation services that are applied equally to our customers.
Information about payment defaults automatically means that your application is only sent to the connected lenders who accept loan applicants who have payment defaults. Information about the debt balance can, as far as consumer loan mediation is concerned, automatically lead to your application not being processed, due to affiliated lenders' own regulations. Your information that you provide in your application is automatically matched with the requirements set by the respective electricity, loan or insurance providers according to their internal regulations and conditions such as loan amount, income, form of employment, age etc.

Your rights as a registered user
As a registered user, you have a number of rights. You have the right to access, to rectification, to object, to restriction of processing, to erasure, to be forgotten and to data portability. To exercise your rights or if you have questions regarding Zmarta's processing of your personal data, you are welcome to contact us via the contact details listed at the end of this information link. Zmarta reserves the right to charge a fee for repeated requests for access to data or to refuse to comply with a request that, for example, occurs on repeated occasions, is unreasonable or is clearly unfounded.
Right to access your personal data
You have the right to receive information about whether Zmarta processes your personal data and, if so, to receive a copy of these.
Right to rectification
If you believe that the personal data concerning you is incorrect or incomplete, you can request to have the data corrected or supplemented.
The right to object to our processing of your personal data
You can object to processing of your personal data that Zmarta does based on legitimate interest. You then need to specify which processing you object to. If we consider that such processing should still take place, we must show that there are interests that outweigh your interests, rights and freedoms. You can also always object to us using your personal data for direct marketing. When you notify us that you no longer wish to receive direct marketing, we will turn off the marketing and stop sending you marketing.
Right to limitation of processing
In some cases, you have the right to request that Zmarta limit the processing of your personal data, e.g. if you have objected to the treatment. By requesting a restriction, you have, at least for a certain period, the opportunity to stop Zmarta from using the data other than to e.g. defend legal claims.
Right to erasure ("the right to be forgotten")
In some cases, you have the right to have your personal data deleted. This applies e.g. if the data is no longer needed for the purposes for which it was collected, or if you object to processing based on a balancing of interests and there are no legitimate reasons that outweigh your interest. However, the right to erasure does not apply in certain cases, e.g. if the processing is necessary for Zmarta to fulfill a legal obligation or for Zmarta to be able to establish, enforce or defend legal claims.
Right to data portability
The right to data portability applies in cases where you have given your consent to the processing or if the processing is necessary for us to be able to provide services to you in accordance with the agreement you entered into with us, and on the condition that the processing takes place automatically and that it is technically possible to move. The right to data portability applies to personal data you have provided with the fulfillment of an agreement or consent as a legal basis.
Period during which the personal data will be processed
The personal data is thinned in accordance with current personal and data protection legislation, which means that the data is not processed for a longer period than is necessary with regard to the purpose of the processing or what is required by law.
- Comparison of loans, electricity contracts and offers are saved for 12 months from the time you used our service in order to fulfill our contract with you.
- Contact details, call recordings, email archiving, application information, technical data are stored for 12 months from the date you last used our service to perform customer service, prevent abuse of our services and handle complaints.
- Documentation of agreements and consents in connection with comparison and purchase (mediation) of insurance as well as comparison, purchase and brokering of insurance must, according to insurance distribution legislation, be saved for at least 10 + 1 years from the time of brokering. The same applies to recorded insurance mediation cases by telephone.
- The application for a loan as well as personal data and other information provided to us in connection with the application for a loan or life insurance (incl. IP address) is saved for 5 years. The information is also processed as part of our preventive work in terms of preventing fraud, money laundering and the financing of terrorism. According to anti-money laundering legislation, we are obliged to save personal data related to mandatory anti-money laundering controls for 5 years.
- We process your personal data for marketing purposes for 36 months from the last date you used our service.
- Data may also need to be saved according to additional requirements in law or other constitution and authority regulations, e.g. the Accounting Act (according to which data must be saved for 7 years).
- Information collected if you choose to supplement your application with account information from your bank account will be deleted after 30 days.
- If you have accepted the Benefit Agreement, your data, including your IP address, will be processed as long as you subscribe to the service and the data is needed to fulfill the Benefit Agreement. If you terminate the agreement, we will delete the data as soon as possible in accordance with applicable law and Zmarta's internal processes. If the agreement becomes passive (i.e. if you do not show interest in the service or its content for a period of 5 years), this will be equated to the agreement being terminated and your personal data will then be deleted in the same way as stated above.
Complaints, data protection officer and supervisory authority
If you have comments or believe that we have handled your personal data incorrectly, you can always contact Zmarta's data protection representative. The data protection officer works for the companies that are responsible for personal data within the Zmarta group:

The overall and most important task of the data protection officer is to check that the data protection regulation (GDPR) is followed within the organization, by, for example, carrying out checks and information efforts.
The representative must also be the contact person for the data subjects and cooperate with the Privacy Protection Authority.

I no longer want marketing, what do I do?
